Book a Photo Booth Event

Let us take this opportunity to let you know how excited we are to provide our photo booth services to you at your special event! We know that you had many choices out there and we are committed to proving that you made the right one by choosing us!

Please do not submit this Photobooth booking form or retainer until you have received confirmation from us that your date is available.

This short form will guide you through the booking process with us, completing the contract, and paying the retainer.

The Service Period will be confirmed via email. Provider agrees to have the photo booth operational for a minimum of 80% during this period; occasionally, operations may need to be interrupted for maintenance of the Photo Booth (changing photo paper, adjusting camera, adjusting lighting, adjusting printer, and etc).

A non-refundable retainer is due upon signing this Agreement. The remaining balance is due no later than five (5) days before Client’s event date. If paying by credit card, Client agrees to have Provider charge Client’s credit card for payment of services. The Client is liable for any additional time they request at the event at the cost of $150.00/hr. (which will be billed in half-hour increments). The Client agrees that in addition to any and all other legal rights and remedies Provider may have, Client will pay a $50 fee for any and all returned checks which Client may write to Provider as payment for services.

Any request for a date, time, or location change must be made in writing at least thirty (30) days in advance of the original event date. Change is subject to photo booth availability and receipt of a new Service Contract. If there is no availability for the alternate date, time, or location, the retainer shall be forfeited and the event canceled. Any cancellation occurring less than thirty (30) days prior to the event date shall forfeit all payments received.

Client will arrange for an appropriate space for the Photo Booth at the event venue. The open concept photo booth setup requires a minimum space 8’ deep x 8’ wide x 8’ high that is level and solid flooring. Client is responsible for ensuring power is available for the Photo Booth. (120V, 5 amps, 3 prong outlet). The outlet must not be shared with any other appliance and be within 25 feet of the booth. Any delay in the performance or damage to the photo booth equipment due to improper power is the responsibility of the client. Photo Booth cannot be taken up stairs. Ramp or elevator access is required. A solid wall is necessary for setup to avoid wind/light interference. Indoor setup or under a covering such as a porch or weatherproof tent/canopy is mandatory. Event may be cancelled and payment forfeited if indoor or covered setup is not available upon delivery. Setup area must be free of potential hazardous materials or items. Children under 12 must be supervised by an adult at all times to avoid injury. The photo booth once setup must not be moved to avoid potential hazard. Provider reserves the right to refuse service if adequate space or power is not provided and all payments shall be forfeited.

The parties understand the Provider has committed to perform services at the event per the conditions of this contract. Accordingly, the parties understand that the Provider will not be able to accept any other engagement for the above date and time. The parties, therefore, agree that in consideration of being unable to pursue other engagements, The Client agrees to pay the total fee above regardless of whether the event is canceled, postponed, or in any other way modified due to weather, catastrophe, or any other force majeure occurring naturally or man made.

Client acknowledges that client shall be financially liable for any accidental damage or theft of the Provider’s Equipment. Client is responsible for loss or damage to provider’s equipment caused by: a) Any misuse of the Provider’s Equipment by Client or its guests.

Upon receiving a downloadable link of the files, Client accepts all responsibility for archiving and protecting the photographs and media. The provider is not responsible for the lifespan of any digital media provided for any future changes in digital technology or media readers that might result in the inability to read the media provided. It is the Client’s responsibility to make sure that digital files are copied to new media as required. Digital image files will only be guaranteed available for download in an online gallery for 90 days.

At all times after the effective date of this Agreement, the Parties shall indemnify each other and their officers, members, managers, employees, owners, sublicensees, affiliates, subsidiaries, successors, and assigns (collectively, the “Indemnitees”) from all damages, liabilities, expenses, claims, or judgments (including interest, penalties, reasonable attorneys’ fees, accounting fees, and expert witness fees) (collectively, the “Claims”) that any Indemnitee may incur and that arise from:

(a)     A Parties’ gross negligence or willful misconduct arising from the Party’s carrying out of its obligations under this Agreement;

(b)     Any breach of any of its obligations or representations under this Agreement. 

Additionally, Client will indemnify Provider from any claim or cause of action arising out of or relating to any event, product, promotion, etc. that is the subject of this or a related agreement, including, but not limited to, any claim or cause of action by an attendee of Client’s event against Provider or any damage caused to Provider’s equipment or personnel caused by Client or one of Client’s event attendees.

Our basic personalized print strip templates are not for customizations or revisions. Only the text itself can be swapped out with similar messaging, which Provider will copy directly from Event Information Form. If Event Information Form is not filled out Provider will provide a generic template at your event. Custom print layouts allow additional graphics such as logos or monograms to be added if provided by Client thirty (30) days before the event. Additional charges may apply to custom layouts if not included in the package.

Client acknowledges that the quality of the Recordings is dependent on a variety of conditions outside of the provider’s control, including but not limited to power outages, background noise levels, the speaking voice and volume of the person making the Recording, and such person’s relative placement of the handset. Provider provides no warranty of any kind as to the quality or intelligibility of any of the Recordings. The Recordings are provided to the client on an “AS IS” basis without warranty of any kind.

If none of the client’s recordings can be retrieved for any reason (other than damage to the Audio Guest Book by guests), the client will receive a full refund of the relevant fees. Provider’s liability resulting from the loss of, damage to, or inability to access the recordings shall be limited to the amount of the fees associated with the phone rental portion of the event only.

Provider’s optional Social Sharing/SMS/Email features require a stable venue internet connection of at least (5MB). The provider is not responsible for unavailable or insufficient image sharing features due to low-quality internet or signal. Any venue WiFi charges are the responsibility of the Client and must be paid and activated no less than 60 minutes before the start of the event. Photos shared and their usage are not the responsibility of the provider. Provider shall be held harmless from any liability of photos shared during or after the event.

Free delivery and setup is included within a fifty (50) mile radius of Salisbury, NC. Mileage over and above 50 miles is billed at $1.00 per mile in each direction. Distances greater than radius defined above must be negotiated with the Provider prior to the event.

The Client shall provide parking details in advance for the Provider attendant’s vehicle and 10′ trailer while at the Client’s event. The client is responsible for any parking charges incurred for the Provider. If not listed and incurred at your event, fee plus $10 will be charged to you. Please note that we utilize both a van and 10′ trailer and must be able to securely park these at the event location.

If there is a requirement for more than 90 minutes between setup and start time or more than 30 minutes after end time and breakdown, a fee per hour for “Idle Time” will be invoiced. The provider cannot set up in the middle of an active event for safety and insurance reasons, therefore, if the event, such as a wedding ceremony and the booth are in the same room and event and booth start times are not the same then idle time fees will apply. Provider can break down during the event as long as it is safe to do so and with the express permission of the Client.

If any one or more of the provisions contained in this Agreement is, for any reason, held to be invalid, illegal, or unenforceable in any respect, that invalidity, illegality, or unenforceability will not affect any other provisions of this Agreement, but this Agreement will be construed as if those invalid, illegal, or unenforceable provisions had never been contained in it, unless the deletion of those provisions would result in such a material change so as to cause completion of the transactions contemplated by this Agreement to be unreasonable.

No waiver of a breach, failure of any condition, or any right or remedy contained in or granted by the provisions of this Agreement will be effective unless it is in writing and signed by the Party waiving the breach, failure, right, or remedy. No waiver of any breach, failure, right, or remedy will be deemed a waiver of any other breach, failure, right, or remedy, whether or not similar, and no waiver will constitute a continuing waiver, unless the writing so specifies.

This Agreement constitutes the final agreement of the Parties. It is the complete and exclusive expression of the Parties’ Agreement with respect to the subject matter of this Agreement. All prior and contemporaneous communications, negotiations, and Agreements between the Parties relating to the subject matter of this Agreement are expressly merged into and superseded by this Agreement. The provisions of this Agreement may not be explained, supplemented, or qualified by evidence of trade usage or a prior course of dealings. Neither party was induced to enter this Agreement by, and neither Party is relying on, any statement, representation, warranty, or Agreement of the other Party except those set forth expressly in this Agreement. Except as set forth expressly in this Agreement, there are no conditions precedent to this Agreement’s effectiveness.

A Party will not be in breach of or in default under this Agreement on account of, and will not be liable to the other Party for, any delay or failure to perform its obligations under this Agreement by reason of fire, earthquake, flood, explosion, strike, riot, war, terrorism, or similar event beyond that Party’s reasonable control (each a “Force Majeure Event”). However, if a Force Majeure Event occurs, the affected Party shall, as soon as practicable:

(a)     notify the other Party of the Force Majeure Event and its impact on performance under this Agreement; and

(b)     use reasonable efforts to resolve any issues resulting from the Force Majeure Event and perform its obligations under this Agreement.

Choice of Law. This Agreement shall be construed under the laws of the State of North Carolina, without regard to its choice or conflict of law principles.

(b)     Choice of Forum. Any claim or cause of action arising out of or related to this Agreement shall be brought in a court of competent jurisdiction in Rowan County, North Carolina or the United States District Court for the Southern District of North Carolina.

(c)     Attorneys’ Fees. If either Party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing Party shall be entitled to its reasonable attorneys’ fees and costs.

Client acknowledges Provider and its representatives shall have the right to decline service to client’s guest (invited or uninvited), for misuse, inappropriate photos or unruly behavior. Children under the age of 13 may be required by attendants to be accompanied by an adult to be granted access to the booth.

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between Provider and Client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, Client agrees to solve any arguments via arbitration. In the event Provider is unable to supply a working photo booth for at least 80% of the Service Period, Client shall be refunded a prorated amount based on the amount of service received. The Provider will be allowed to give a website link to the Client where their guests can log onto to download the digital files for their own use. The Provider will print 1 set of copies of the photos from the event and provide it to client after the event, if the printer fails.

The Client understands and agrees that all sales and service fees are final.

I hereby expressly waive and release any and all claims, now known or hereafter known, against the Provider and its owners, employees, affiliates, and officers, on account of injury, illness, disability, or death arising out of or attributable to being on the Premises or engaging in the provided activity and being exposed to or contracting COVID-19 or any other disease or illness, whether arising out of the negligence of the Provider, its owners, employees, affiliates, officers, or otherwise, to the fullest extent permitted by law. It is solely and completely the client’s responsibility for ensuring the safety and well-being of guests.

A $100 non-refundable retainer is due upon signing this Agreement. The remaining balance is due no later than seven (7) days before Client’s event date. If paying by credit card, Client agrees to have Provider charge Client’s credit card for payment of services. The Client is liable for any additional time they request at the event at the cost of $150.00/hr. (which will be billed in half-hour increments). The Client agrees that in addition to any and all other legal rights and remedies Provider may have, Client will pay a $50 fee for any and all returned checks which Client may write to Provider as payment for services.

Your reservation and this contract is not in effect until the retainer is received. You may pay by Credit Card/ACH now or send a check.
